Terms & Conditions

Version of 15/11/2023

1) General clause

The “Supplier”: MARTIN SA, which is registered in the Thonon les bains trade register under number 401 366 745 and located at 403 D Route de la Gare, ZI de Mésinges, is active in the manufacture of multi-ply wood.

The “Customer”: any natural or legal person who purchases products from our online store.

The Customer and the Supplier are hereinafter referred to individually or collectively as the “Party(ies)”.

“GSC”: the General Terms and Conditions of Sale, the subject of this document, applicable to the Products in our online store.
The purpose of the GSC is to define the respective rights and obligations of the Customer and the Supplier within the framework of the commercial sales relationship.

All orders imply the Customer’s unreserved acceptance of and full compliance with the GTS, which prevail over all other documents, including any other purchasing conditions of the Customer, unless expressly agreed otherwise between the Parties.

2) Confidentiality

All plans, photos, drawings, studies and documents delivered or sent by the supplier remain his property. They may not be altered, copied, reproduced or communicated to third parties for any reason whatsoever by the customer, nor may they be used for any purpose other than those specified on our website.

3) Product modification

The supplier reserves the right to make any changes it deems necessary to its products at any time and, without obligation to modify products previously delivered or in the process of being ordered, it reserves the right to modify, without prior notice, the models defined on its website as well as those offered on social networks.

4) Delivery

Deliveries are made to the address indicated in the online purchase confirmation. Delivery times may vary according to production, stock and material availability. Production and delivery may vary between 5 and 15 working days.

We will do our utmost to ensure prompt delivery and transparent information on delivery times. Your delivery time depends on the time it takes for us to dispatch your order, and then on the time it takes for our service provider to deliver it. This time does not depend solely on us; it may be extended due to bad weather, strikes, etc.

5) Return conditions

You have a legal period of 14 days from receipt of your purchases to retract by email, without need to justify your decision. We will provide you with the return address by e-mail. Products must not have been damaged or soiled and must be returned in packaging suitable for transport and at your expense. If you wish, we can e-mail you a prepaid shipping label, which you simply print out and affix to the parcel; the cost will then be deducted from the refund.

If your claim is justified by a non-conformity, we will cover your return shipping costs. We’ll send you a shipping label by e-mail, which you simply print out and affix to the package before handing it over to the carrier.

6) What should I do if my parcel is not delivered on time?

If you have not received your parcel within 10 calendar days, we advise you to contact our customer service department by e-mail. Our team will take care of filing a claim with the carrier on your behalf.
Some carriers impose a time limit on claims. Please refer to their terms and conditions.

7) Prices and financial terms

3-1) Rates

The prices quoted on our site include any discounts and rebates that the Supplier may grant.

3-2) Payment terms

The customer can choose between the following payment methods:

  • Online payment by credit card
  • Offline payment by bank transfer, depending on quantity ordered

Payments made by the Customer are not considered final until the Supplier has actually received the sums due.

The Supplier is not obliged to deliver the goods ordered by the Customer if the latter does not pay the price in full.

8) Warranty

Products are warranted against defects in materials and workmanship for a period of 1 year from the date of delivery.
The supplier’s sole obligation under this warranty shall be the repair or replacement, at its own expense, of the product or component recognized as defective by its services. Any shipping costs will be borne by the customer.

The warranty only applies to products used under normal care and maintenance conditions. It does not apply to repairs and replacements resulting from normal wear and tear, carelessness or misuse.
Normal wear and tear includes dirt from all sources, deterioration caused by various pollutants, and slight changes in color over time. Lack of care or improper use includes cleaning with a product that is not recommended or is abrasive, cigarette or other burns, severe shocks that may alter the varnish film and accelerate product degradation, as well as prolonged use all year round in an environment that may be subject to cold, snow, frost, permanent humidity, etc.

9) Limitation of liability

The supplier shall not be liable for any indemnity or compensation of any kind whatsoever for any indirect loss, in particular loss of profit, loss of clientele, loss of earnings, or for any consequences of claims against the customer. In all cases, the supplier’s liability is limited to the amount of the products, exclusive of tax.

10) Right of withdrawal

The customer has a period of fourteen clear days, from receipt of the products, to exercise his right of withdrawal without having to give any reason or pay any penalties, with the exception of the cost of returning the products, which is at the customer’s expense. If the fourteen-day period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

To exercise his right of withdrawal, the Customer must use the form accessible by clicking on the button below:

Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.). In the event of depreciation, the Customer may be held liable.

11) Disputes

For any complaint, the Customer must contact and notify the Supplier by e-mail at martin@sa-martin.fr or via the site’s contact form. The Supplier will make every effort to deal with the complaint as quickly as possible.

In the event of a dispute between the Parties, the Parties expressly agree to seek an amicable solution.
